Mobile Terms of Service

These Wizard Perks Mobile Service Terms (the “Mobile Terms”) govern your purchase and use of wireless voice, messaging, and data service and any assigned phone number (collectively, the “Mobile Service”) offered by Wizard Perks, Inc. (“Wizard Perks,” “we,” “us”).
The Mobile Terms are in addition to, and are incorporated by reference into, the Wizard Perks Terms of Service (the “General Terms”) and the Privacy Policy. If you do not agree to these Mobile Terms, do not purchase or use the Mobile Service.
Please read Section 13 (Binding Arbitration and Class Action Waiver) carefully. It affects your legal rights, requires most disputes to be resolved by individual arbitration, and waives your right to participate in a class action. Section 13.5 explains how to opt out of arbitration.
1. Scope and Acceptance
1.1 Scope. These Mobile Terms apply only to the Mobile Service. They do not apply to any other part of the Wizard Perks platform, which remains governed by the General Terms.
1.2 Acceptance. You accept these Mobile Terms by affirmatively indicating your agreement at the time you purchase a line of Mobile Service, and by activating or using the Mobile Service. Wizard Perks records the date, time, and version of the Mobile Terms you accepted.
1.3 Eligibility. You must be at least 18 years old, a resident of the United States, and an authorized member of the Wizard Perks platform through your sponsoring organization.
2. Definitions
“Carrier” means the underlying wireless network operator, T-Mobile USA, Inc., over whose network the Mobile Service is provided.
“Line” means a single activated subscription to the Mobile Service, together with its assigned phone number and SIM or eSIM.
“Referring Platform” means any third-party mobile application, marketplace, employer, gig-economy application, corporate perk portal, or marketing platform through which you accessed or discovered the Mobile Service.
3. Relationship with the Underlying Carrier
3.1 No direct contract. You acknowledge and agree that you have no contractual relationship with, and are not a third-party beneficiary of, any agreement between Wizard Perks and the Carrier.
3.2 No Carrier liability. You agree that neither Wizard Perks nor the Carrier shall have any legal, equitable, or other liability of any kind for claims, damages, or losses arising from or related to the Mobile Service or any assigned phone number.
3.3 Wizard Perks is the provider of record. The Mobile Service and its rate plans are fulfilled, billed, and managed solely by Wizard Perks. All billing, support, and account inquiries must be directed to Wizard Perks, not to the Carrier.
4. Phone Numbers
Subject to applicable FCC rules, you have no property or ownership rights in any assigned phone number. Assigned numbers may be modified or reassigned as required by applicable regulations or Carrier policies.
5. Service Availability and Network Limitations
5.1 Interruptions. The Mobile Service may be temporarily refused, limited, or interrupted due to atmospheric conditions, terrain, network upgrades, maintenance, or usage congestion. Neither Wizard Perks nor the Carrier is liable for any failure or interruption of service.
5.2 Coverage. Coverage maps and speed estimates are approximations. Actual service availability, speed, and quality vary by location, device, network conditions, and plan.
5.3 Security of transmissions. You understand that wireless transmissions are not inherently secure and that neither Wizard Perks nor the Carrier guarantees the security of any transmission.
5.4 Equipment. You assume all risk regarding device and equipment compatibility and use. Wizard Perks does not warrant that any particular device will function on the Carrier’s network.
6. Emergency Services (911)
You acknowledge the inherent limitations of wireless 911 services, including potential location accuracy issues and dependence on device battery level and network availability. Wireless 911 service may not be available where there is no network coverage or where the device is powered off or without charge.
7. Prohibited Uses
You may not use the Mobile Service for any of the following:
7.1 Machine-to-machine remote monitoring for life-sustaining medical care.
7.2 Reselling calling card products or “grab-and-go” pin-code recharge cards.
7.3 Unbranded (“white label”) voice services that attempt to create an unauthorized new wireless brand.
7.4 Monitoring third parties without their consent, including parolee or prisoner tracking.
7.5 Auto-dialing, telemarketing, spamming, SIM-boxing, machine-to-machine data scraping, or any activity that interferes with network operations.
7.6 Any fraudulent, illegal, unauthorized, or abusive use.
7.7 Reselling, sublicensing, or otherwise making the Mobile Service available to any third party.
8. Suspension and Termination
8.1 Suspension for suspected misuse. Wizard Perks and the Carrier reserve the right to immediately suspend, restrict, throttle, or terminate any Line without prior notice or liability if either reasonably suspects fraudulent, illegal, unauthorized, or abusive usage, including any use prohibited under Section 7.
8.2 Termination of the master agreement. The Mobile Service may be suspended or terminated immediately without notice if the master agreement between Wizard Perks and the Carrier is terminated. You waive any and all claims against the Carrier for such suspension or termination.
8.3 Termination for non-payment. Wizard Perks may suspend or terminate any Line for non-payment, chargeback, or dishonored payment, as described in Section 10.
8.4 Effect of termination. On termination, your right to use the Mobile Service and any assigned phone number ends immediately. You remain responsible for all charges incurred through the termination date.
9. Cancellation by You
9.1 How to cancel. You may cancel a Line at any time by emailing team@wizardperks.com. Cancellation is effective at the end of the then-current billing period.
9.2 No partial-period refunds. Charges for the billing period in which cancellation occurs are not prorated or refunded, except where required by law.
9.3 Number portability. You may request to port your assigned number to another carrier before cancelling. Once a Line is cancelled, the number may be reassigned and may no longer be portable.
10. Fees, Billing, and Automatic Payment
10.1 Financial responsibility. You accept full financial responsibility for all charges, monthly recurring fees, and usage generated under your Line(s).
10.2 Automatic billing authorization. You expressly authorize Wizard Perks, Inc. to automatically charge your designated payment method on file, on a recurring monthly basis until you cancel, for all monthly subscription fees, applicable taxes, regulatory surcharges, and any unbilled usage fees, including international roaming or out-of-plan usage.
10.3 Price changes. Wizard Perks will provide notice before any increase to your recurring monthly fee takes effect. Continued use of the Mobile Service after the effective date of the change constitutes acceptance of the new price. Taxes and regulatory surcharges may change without notice.
10.4 Chargebacks and collection costs. In the event of a credit card chargeback, dishonored payment, or payment dispute initiated by you, Wizard Perks reserves the right to immediately deactivate the associated Line(s). You agree to pay an administrative chargeback recovery fee of $35.00 per incident, plus all reasonable collection costs, court costs, and outside attorneys’ fees incurred by Wizard Perks in recovering unpaid balances.
11. Third-Party Platforms and Referring Platforms
You acknowledge and agree that any Referring Platform is solely an independent referrer and has zero operational responsibility, legal liability, or obligation regarding network performance, line activation, billing disputes, coverage, or service availability. All such responsibility rests with Wizard Perks.
12. Limitation of Liability
12.1 No consequential damages. To the maximum extent permitted by applicable law, in no event shall Wizard Perks, Inc., its officers, directors, employees, or underlying service providers be liable to you for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, lost gig-economy wages, business interruption, or loss of data, arising out of or in connection with the use of or inability to use the Mobile Service.
12.2 Liability cap. The total aggregate liability of Wizard Perks, Inc. to you for all claims arising under or related to the Mobile Service shall not exceed the total amount actually paid by you to Wizard Perks, Inc. for the specific Line of service during the one (1) month period immediately preceding the event giving rise to the claim.
12.3 Exclusions. Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations in this Section 12 apply to the fullest extent permitted by law.
13. Binding Arbitration and Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.
13.1 Agreement to arbitrate. You agree that any dispute, claim, or controversy arising out of or relating to the Mobile Service, assigned numbers, billing, or these Mobile Terms shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Commercial Arbitration Rules.
13.2 Class action waiver. You expressly waive any right to initiate, join, or participate as a plaintiff, class member, or representative in any class action, collective lawsuit, or consolidated proceeding against Wizard Perks, Inc., its affiliates, officers, or underlying service providers.
13.3 Small claims exception. Either party may bring an individual claim in small claims court if the claim qualifies and remains in that court.
13.4 Precedence over the General Terms. This Section 13 supersedes the “Governing Law and Venue” section of the General Terms with respect to disputes concerning the Mobile Service. All other disputes remain governed by the General Terms.
13.5 Your right to opt out of arbitration. You may opt out of this Section 13 by emailing team@wizardperks.com with the subject line “Arbitration Opt-Out” within thirty (30) days of first accepting these Mobile Terms, including your name and the phone number or account associated with your Line. Opting out will not affect any other part of these Mobile Terms, and will not affect your Mobile Service. If you opt out, disputes concerning the Mobile Service will be governed by the “Governing Law and Venue” section of the General Terms.
13.6 Severability. If Section 13.2 is found unenforceable, the entirety of this Section 13 is void, and disputes will be resolved in the courts identified in the General Terms.
14. Relationship to the General Terms
14.1 Incorporation. These Mobile Terms are incorporated into and form part of the General Terms.
14.2 Order of precedence. In the event of any conflict between these Mobile Terms and the General Terms, these Mobile Terms control with respect to the Mobile Service. The General Terms control in all other respects.
14.3 Commercial use carve-out. The General Terms restrict use of the Wizard Perks platform to personal, non-commercial purposes. That restriction does not prohibit ordinary personal or sole-proprietor use of the Mobile Service, but the prohibitions in Section 7 apply in full.
15. Changes to These Mobile Terms
Wizard Perks may revise these Mobile Terms. Material changes will take effect no earlier than thirty (30) days after we notify you by email or in-app notice, and we will ask you to accept the revised version. If you do not accept a material revision, your sole remedy is to cancel your Line under Section 9 before the revision takes effect. Non-material changes take effect on posting.
